The Kuttepalat.com online store provides a safe and convenient way to purchase goods.

Payments are processed by Maksekeskus AS.

KÜTTEPALAT OÜ is the controller of personal data. KÜTTEPALAT OÜ transfers the personal data necessary for processing payments to the authorised processor Maksekeskus AS.

Contract

These terms and conditions constitute the sales agreement between a consumer or other customer purchasing from the online store and KÜTTEPALAT OÜ (hereinafter referred to as the "Seller").

By purchasing from our online store, you agree to these terms and conditions.

Goods are not sold through the online store to buyers for the purpose of resale. For resale enquiries, please contact us at info@bairaneu.com.

The Seller reserves the right to change prices and these terms and conditions at any time without prior notice. Prices applicable to orders already placed or contracts already concluded will not be changed unilaterally.

Purchasing

Descriptions and prices of the goods are provided with each respective product. All prices are stated in euros and include the value-added tax applicable in the Republic of Estonia.

Select the desired products and add them to your shopping cart, specifying the required quantity. You can review the contents of your shopping cart at any time by clicking the shopping cart icon in the website header.

Once all required products have been added to the shopping cart, proceed to the next page and accurately complete all fields required for delivery of the order. Fields marked with an asterisk (*) are mandatory for placing an order.

If you have any additional information or special instructions regarding your order, please enter them in the notes field of the shopping cart.

Before proceeding to payment, please make sure that the selected products, quantities and prices are correct.

Confirm your order. You will then be redirected to the selected payment environment. Follow the instructions provided there carefully.

After the payment has been confirmed, we will send an order confirmation to the e-mail address provided by you.

Consumer's Right of Withdrawal

Under applicable law, a consumer has the right to withdraw from the contract within 14 days of receiving the ordered goods and return the goods unused and in their original, undamaged packaging.

The right of withdrawal applies only to consumers, i.e. natural persons who enter into a transaction for purposes unrelated to their independent economic or professional activities. Other persons are not considered consumers for the purposes of the right of withdrawal.

The right of withdrawal is preserved provided that the products have not been handled in a manner other than what is necessary to inspect the nature, characteristics and functioning of the goods in a manner normally permitted in a physical store.

The right of withdrawal cannot be exercised if the consumer opens the sealed packaging of a cosmetic product and, for reasons of health protection or hygiene, the product can no longer be offered to third parties.

NB! To preserve your right of withdrawal, please open boxes and other packaging carefully and do not open packages covered with a protective film where removing the film would damage or compromise the packaging.

The consumer must return the goods to the Seller no later than 14 days after submitting the notice of withdrawal.

If you have withdrawn from the contract and returned the unused goods to us, we will refund the amount paid for the goods and the original delivery fee within 14 days of receiving the notice of withdrawal.

The consumer is responsible for the cost of returning the goods. The Seller does not reimburse return shipping costs.

Consumer Remedies

In the event that the goods do not conform to the terms of the contract, the consumer has the right to rely on the remedies provided by law, including the right to:

• require performance of the obligation;

• refuse to perform an obligation owed by the consumer;

• claim compensation for damages;

• withdraw from the contract or terminate the contract;

• demand a reduction in price;

• in the event of delay in the performance of a monetary obligation, demand payment of late-payment interest.

The consumer has the right to submit a complaint to an out-of-court body responsible for resolving consumer complaints and disputes. Relevant instructions can be found on the website of the Estonian Consumer Protection and Technical Regulatory Authority.

Quality

Before dispatching goods, we inspect all products. However, if you discover that the goods delivered are defective, please do not use the products and notify us by e-mail or in writing as soon as possible, but no later than two months after receiving the goods.

If the goods are defective due to circumstances attributable to us, we will repair or replace the defective goods or refund the amount paid for the defective goods in our online store.

Damaged products must not be used. Any use of a damaged product is at the buyer's own risk. We will not refund or replace a defective product if it has already been used.

The Seller is liable for any non-conformity of the goods with the contractual terms that existed at the time the goods were delivered to the consumer.

In the case of sales to consumers, the Seller is liable for any non-conformity of the goods with the contractual terms that becomes apparent within two years from the date the goods were delivered to the consumer. It is presumed that any non-conformity that becomes apparent within six months of delivery to the consumer existed at the time of delivery, unless such a presumption is incompatible with the nature of the goods or the defect.

Safety

It is very important to carefully follow the instructions for use provided on the website and supplied with the goods, as well as all other applicable safety requirements.

We are not liable for any damage resulting from the use of a product if the product was not used for its intended purpose, the manufacturer's instructions were not followed, or other applicable safety requirements were not observed.

The content of this website, including its interface, design, photographs and texts, is protected by copyright.

The exclusive rights to use the content of the website belong to KÜTTEPALAT OÜ or to the respective author indicated on the website.

The content of the website may not be used, reproduced, distributed or modified in any manner without the prior written consent of KÜTTEPALAT OÜ, except where such right arises directly from applicable law.

Applicable Law

The use of this website and the legal notices published on the website are governed by and shall be interpreted in accordance with the laws of the Republic of Estonia.

Any disputes shall be resolved in accordance with Estonian law by Harju County Court, unless otherwise expressly provided by law.

Changes

KÜTTEPALAT OÜ reserves the right to amend these website rules and terms and conditions at any time without prior notice.

DELIVERY OF GOODS

Goods are shipped within the European Union.

The buyer can choose from the following delivery options:

• Collection in person at Tartu County, Kambja Parish, Külitse village, Külitse tee 14a, 61702, Estonia.

• DPD parcel lockers.

• Omniva parcel lockers.

The buyer is responsible for the delivery costs. The applicable delivery fee is displayed next to the selected delivery method.

Domestic shipments within Estonia generally reach the destination specified by the buyer within 4 business days from the entry into force of the sales contract.

For deliveries outside Estonia, delivery generally takes up to 14 business days.

In exceptional circumstances, the Seller has the right to deliver the goods within up to 45 calendar days.

Although we do our best to ensure that your order arrives as quickly as possible, we cannot be held responsible for delays caused by the transport or delivery service provider.
